2026 Adjustment of Status Updates
If you are applying for a green card from inside the United States, 2026 brought several major changes to the adjustment of status (AOS) process. Here is what applicants filing Form I-485 need to know now.
New Form I-485 Edition — Required September 18, 2026
USCIS will publish a revised Form I-485 (edition date 09/18/26) to align with the Public Charge Ground of Inadmissibility Final Rule. There is no grace period.
USCIS will publish a revised Form I-485 (edition date 09/18/26) to align with the Public Charge Ground of Inadmissibility Final Rule. There is no grace period.
- On or after September 18, 2026: USCIS accepts only the 09/18/26 edition. The 01/20/25 edition will be rejected if postmarked or electronically submitted on or after that date.
- Do not file the new edition early — USCIS will not accept the 09/18/26 edition before September 18, 2026.
The revised form expands Part 9 with questions on household income, assets, liabilities, education, workforce skills, family status, and receipt of means-tested public benefits. USCIS has published a preview version on [uscis.gov/i-485](https://www.uscis.gov/i-485).
### Public Charge Rule — Effective September 18, 2026
DHS rescinded the 2022 Biden-era public charge regulation (final rule effective September 18, 2026). For I-485 applications postmarked or submitted on or after that date:
- USCIS applies a totality-of-the-circumstances test using five statutory factors and any other relevant evidence.
- Means-tested public benefits received on or after September 18, 2026 may be considered broadly — including cash assistance, housing assistance, SNAP, and financial aid for college.
- Benefits received before September 18, 2026 are evaluated under the narrower 2022 standard (cash assistance for income maintenance and long-term institutionalization only).
- Form I-864 (Affidavit of Support) remains critical in most family-based cases.
### September 2026 Visa Bulletin & Concurrent Filing
Each month, USCIS designates which Visa Bulletin chart controls when you may file Form I-485:
- September 2026 — Family-sponsored categories: Use the Dates for Filing chart.
- September 2026 — Employment-based categories: Use the Final Action Dates chart.
Concurrent filing (I-485 with a pending or concurrently filed I-130 or I-140) remains available when a visa number is immediately available in your category. Immediate relatives of U.S. citizens may always file concurrently because no visa cap applies.
Check USCIS's [Adjustment of Status Filing Charts](https://www.uscis.gov/green-card/green-card-processes-and-procedures/visa-availability-priority-dates/adjustment-of-status-filing-charts-from-the-visa-bulletin) each month before filing — using the wrong chart can result in rejection.
### Stricter Evidence Standards (Policy Alert PA-2026-05)
The August 5, 2026 RFE policy applies directly to I-485 filings. USCIS may deny an I-485 without first issuing an RFE when required initial evidence is missing or eligibility is not established (8 CFR § 103.2(b)(8)(ii)).
Before filing I-485, confirm you have:
- Correct form edition for your filing date
- All required supporting documents listed in form instructions
- Medical exam (Form I-693) if required
- I-864 and financial evidence for family cases
- Complete public charge documentation if filing on or after September 18, 2026
### Practical Tips for 2026 AOS Filers
- If filing before September 18, use the 01/20/25 I-485 and current public charge rules.
- If filing on or after September 18, use the 09/18/26 I-485 and prepare expanded public charge evidence.
- Verify visa availability using the correct September 2026 chart for your category.
- File a complete package — do not rely on an RFE to add missing documents later.
